This Privacy Policy (“Policy”) explains how Educational Resource Systems, Inc. (“ERS,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal data when you visit educationalresource.com (the “Site”) or otherwise interact with us through the Site.
This Policy applies to Site visitors, prospective clients, and business contacts. It does not govern personal data processed within the scope of an ERS client engagement or through ERS’s VERSE Insights platform, which are addressed separately in the applicable client or platform agreement.
By using the Site, you acknowledge that you have read and understood this Policy.
ERS is a life sciences learning and development company. For purposes of this Policy and applicable data protection law, including the EU General Data Protection Regulation (“GDPR”) and the UK GDPR, ERS is the data controller responsible for personal data collected through the Site.

Depending on how you interact with the Site, we may collect the following categories of personal data:
Identity Data — name, job title, employer/company name
Contact Data — email address, phone number, business mailing address
Technical Data — IP address, browser type and version, device type, operating system
Usage Data — pages visited, time on page, referral source, and on-site click activity
Marketing and Communications Data — your preferences in receiving marketing from us and your communication preferences
We do not request or knowingly collect Special Category data (e.g., health information, racial or ethnic origin, religious belief) through the Site.
Direct interactions — when you complete a form (e.g., “Request a Demo,” “Contact Us”), subscribe to communications, or correspond with us by email or phone
Automated technologies — through cookies and similar tracking technologies as you navigate the Site (see Section 5 below)
Third-party and publicly available sources — limited professional contact information obtained from publicly available sources, including professional networking platforms, company websites, and business directories, for the purpose of developing and maintaining business relationships and pursuing our legitimate interests in marketing our products and services to business customers.

Google Ads — helps us measure advertising performance, understand the effectiveness of advertising campaigns, and deliver and optimize marketing activities.
LinkedIn Insight Tag — helps us measure campaign performance, understand audience engagement, and, where permitted, support advertising and remarketing activities. LinkedIn processes information collected through the Insight Tag in accordance with its Privacy Policy at https://www.linkedin.com/legal/privacy-policy.

ERS does not sell, rent, or trade personal data. We may share personal data in the following circumstances:
NetSuite — used as our customer relationship management (CRM) platform to manage business contacts, inquiries, customer relationships, and related communications.
Service providers who support Site hosting, email delivery, and analytics, under contractual confidentiality and data protection obligations
Professional advisors (legal, accounting, audit), where necessary to obtain advice
Regulators, courts, or public authorities, where required by law
A successor entity, in the event of a merger, acquisition, financing, or sale of business assets, under the terms of this Policy
Where third-party service providers process personal data on our behalf, we require such providers to maintain appropriate confidentiality, security, and data protection measures and to process personal data only in accordance with applicable law and our instructions.
The Site is hosted in the United States. If you access the Site from the European Economic Area (“EEA”), United Kingdom, or Canada, your personal data will be transferred to, and processed in, the United States.
Where personal data is transferred outside the EEA or the United Kingdom to a country that has not been recognized as providing an adequate level of data protection, ERS implements appropriate safeguards designed to protect such personal data including the European Commission’s Standard Contractual Clauses and, where applicable, the UK International Data Transfer Addendum or other approved transfer mechanisms. ERS may also implement supplementary technical, contractual, and organizational safeguards where necessary.
We retain personal data only for so long as necessary to fulfill the purposes described in this Policy, including to satisfy legal, accounting, regulatory, tax, contractual, and reporting requirements.
In general:
Contact and inquiry information is retained for up to three (3) years following our most recent interaction with you unless a longer retention period is required or permitted by law or justified by a legitimate business need.
Marketing preference information is retained until you withdraw your consent or opt out of communications, and for a reasonable period thereafter to maintain suppression records.
Technical, analytics, and cookie-related information is retained in accordance with our business requirements and the retention settings associated with the applicable analytics or advertising platform.
Personal data may be retained longer where necessary to establish, exercise, or defend legal claims or comply with legal obligations.
When personal data is no longer required for the purposes described in this Policy, ERS will securely delete the data or, where appropriate, de-identify or aggregate the data so that it can no longer reasonably be associated with an identifiable individual.
ERS maintains reasonable and appropriate administrative, technical, physical, and organizational safeguards designed to protect personal data against accidental, unlawful, or unauthorized access, destruction, loss, alteration, disclosure, or misuse.
These safeguards are designed to be consistent with applicable privacy, cybersecurity, and data protection laws and are periodically reviewed and updated as appropriate.
However, no method of transmission over the Internet and no method of electronic storage is completely secure. Accordingly, while ERS strives to protect personal data, we cannot guarantee absolute privacy.
In the event ERS becomes aware of a security incident involving personal data, ERS will promptly evaluate the nature and scope of the incident and take appropriate steps to mitigate potential harm and prevent recurrence.
Where required by applicable law, ERS will notify affected individuals, regulators, law enforcement agencies or others, as necessary within time limits prescribed by law.
ERS may engage third parties, such as forensic, legal, cybersecurity or other professional advisors to assist in the investigation and remediation of security incidents.
Nothing in this Policy shall be construed as an admission of liability or as creating any obligation beyond those required by applicable law.
If you are in the EEA, UK, or another jurisdiction with similar protections, you have the right to:
Be informed about how your personal data is collected and used
Access the personal data we hold about you
Correct inaccurate or incomplete personal data
Request deletion of your personal data (“right to be forgotten”)
Restrict or object to certain processing, including for direct marketing

Depending on your jurisdiction and applicable law, you may have additional rights regarding the processing of your personal data. ERS will respond to requests in accordance with applicable legal requirements and your relationships with ERS.
To exercise any applicable privacy rights, contact us using the information in Section 17 below. We may request information necessary to verify your identity before responding to your request. Where GDPR or UK GDPR applies, we generally respond to verified requests within one month, subject to any extensions permitted by applicable law.
If you are located in Canada, ERS’s commercial electronic communications with you are governed by Canada’s Anti-Spam Legislation (“CASL”). We collect and use your personal information for commercial purposes. We send marketing emails only if we have obtained your express opt-in or implied consent under the law. Every marketing message includes a functional, instantaneous “Unsubscribe” mechanism to unsubscribe at any time.
While your information resides outside Canada, it is subject to foreign local laws. U.S. courts, law enforcement and national security authorities may obtain lawful access to your data under applicable local law.

ERS does not sell personal information as that term is generally understood under applicable privacy laws.
California residents may contract ERS using the information in Section 17 below to inquire about applicable privacy rights and ERS’s data handling practices.
To the extent any California privacy law applies to ERS and grants additional rights to California residents, ERS will comply with such requirements as applicable.
The Site is directed to business professionals and is not intended for children. ERS does not knowingly collect personal data from children under the age of 13. If ERS becomes aware that personal data of a child under 13 has been collected through the Site, ERS will take reasonable steps to delete such information promptly.
The Site may contain links to third-party websites. We do not control, and are not responsible for, the privacy practices or content of those sites. We encourage you to review the privacy policy of any third-party site before providing personal data to it.
We may update this Policy from time to time. Material changes will be posted on this page with a revised effective date. We encourage you to review this Policy periodically. Where required by applicable law, ERS will provide additional notice regarding material changes to this Policy.
